This paper reports on the results of a survey of faculty members at California State University, Northridge in Los Angeles, California regarding their understanding of and familiarity with the concept of fake news. With very few studies published on the attitudes of teaching faculty at universities, this study is a unique approach to the issues facing educators, knowledge creators, and information specialists. The paper examines the origins of the term “fake news”, the factors contributing to its current prevalence, and proposes (...) a new definition. It also reports upon the attitudes that teaching faculty hold, and how they define fake news within their specific disciplines. Though nearly all surveyed faculty felt fake news was an important topic that impacted them professionally, the researchers also find that faculty across all disciplines and ranks, ages, and gender, hold widely differing conceptions of fake news. This lack of consensus may have future implications for students in particular and higher education in general and are worth exploring further. (shrink)

This second volume of Eric Voegelin’s miscellaneous papers contains unpublished writings from the time of his forced emigration from Austria in 1938 until his death in 1985. The volume’s focus is on dialogue and discussion, presenting Voegelin in the role of lecturer, discussant, and respondent. “The Drama of Humanity” presents the Walter Turner Candler Lectures delivered in four parts at Emory University in 1967. This text, a small book in itself, addresses the themes of “The Contemporary Situation,” “Man in (...) the Cosmos,” “The Epiphany of Man,” and “Man in Revolt,” providing the reader with a good introduction to Voegelin’s later work. Another extensive text included in this volume is “Conversations with Eric Voegelin at the Thomas More Institute” in Montreal. These exchanges include lectures and discussions given by Voegelin between 1967 and 1976. A number of other sections offer insight into Voegelin’s intellectual development over a period of forty years. These include the complete “Foreword” to the second edition of _The Political Religions, _which is published here for the first time; “Notes on T. S. Eliot’s _Four Quartets_;” the “Cycle Theory and Disintegrations;” “What Is Political Theory?;” “The Spiritual and Political Future of the Western World;” “Notes on ‘Civilization and Foreign Affairs;’” “Structures of Consciousness;” “The Beyond and Its Parousia;” and the 1983 “Responses at the Panel Discussion of ‘The Beginning of the Beginning.’” Several lengthy excerpts from conference dialogues with other scholars are also included: “The West and the Meaning of Industrial Society,” “Natural Law in Political Theory,” and “Man in Political Institutions.” Volume 33 concludes with Voegelin’s “Autobiographical Statement at the Age of Eighty-Two,” his last public utterance on the course of his life and his life’s work. By choosing dialogue as the focus of this volume, Petropulos and Weiss are able to show not only the extent to which Voegelin engaged in an exchange of ideas but also his abiding concern for the practical and theoretical conditions necessary in order for this exchange to take place. This dissertation advances the Doctrine of the Subtle Worlds, which holds that the physical world is a small cross-section of the real world, and that the real world is composed of several different, separate but partially overlapping realms of being, each with its own unique characteristics, and each inhabited by various beings such as angels, demons, and disincarnate human beings. This Doctrine was held by all premodern civilizations, and has, in modern times, been advanced in Theosophy and in the cosmology (...) of Sri Aurobindo. This dissertation introduces the doctrine, explores its presentation in Sri Aurobindo, and then uses elements of Alfred North Whitehead's philosophy of science and elements of his later metaphysical scheme to first outline Whitehead's revolutionary understanding of time, space and matter, and then, in terms of that understanding, to demonstrate a meaningful relationship between the Doctrine of the Subtle Worlds and the world as it is understood by modern science. Scholarly correspondence can be as insightful as scholarly work itself, as it often documents the motivating forces of its writers’ intellectual ideas while illuminating their lives more clearly. The more complex the authors’ scholarly works and the more troubled the eras in which they lived, the more substantial, and potentially fascinating, their correspondence. This is especially true of the letters between Alfred Schutz and Eric Voegelin. The scholars lived in incredibly dramatic times and produced profound, complex works that continue (...) to confound academics. The communication between these two giants of the social sciences, as they sent their thoughts to one another, was crucial to the work of both men. _A Friendship That Lasted a Lifetime: The Correspondence between Alfred Schutz and Eric Voegelin _demonstrates that Schutz and Voegelin shared a remarkable friendship: they first met as students in Vienna in the 1920s and found themselves great partners in discussion; years later they were pushed out of Europe by Nazi pressure and went to work at separate American universities. For twenty years they wrote each other, developing their respective scientific works in that dialogue. The letters bear witness to their friendship during the years they spent in exile in the United States, and they document the men’s tentative attempts at formulating the theories of “lifeworld” and “gnosis” associated with Schutz and Voegelin today. The entire collection of 238 letters was printed in German in 2004, but this edited volume is the first to present their correspondence in English and offers a selection of the most important letters—those that contributed to the thinkers’ theoretical discussions and served as background to their most significant thoughts. Editors Gerhard Wagner and Gilbert Weiss do not analyze Schutz’s and Voegelin’s works in light of the correspondence—rather, they present the collection to create a framework for new interpretations. _A Friendship That Lasted a Lifetime_ takes a unique look at two major social scientists. This volume is a valuable resource in the study of Voegelin’s political philosophy and Alfred Schutz’s contribution to American sociology and marks an important addition to the literature on these remarkable men. Showing how scholarly discourse and the dialogue of everyday life can shed light on one another, the book finally presents this correspondence for an American audience and is not to be missed by scholars of philosophy and sociology. Under the balmy Mediterranean skies of Santa Margherita Ligure on the beautiful Italian Riviera, forty Hegelian scholars from nine countries put their heads together on the theme “Hegel’s Philosophie des subjectiven Geistes” at the Conference of the Internationale Hegel-Vereinigung, May 24–27, 1973. Enjoying the generosity of the Italian Government and the official hospitality of the Municipality of Santa Margherita, the participants heard and discussed four papers by German scholars, two each by Italians and Americans, and one each by a Dutch (...) and a French scholar. Professor Valerio Verra of the University of Rome served as host, and Professor Dieter Henrich, President of the Internationale Hegel-Vereinigung, introduced the theme of the Conference and officiated the proceedings. Chairing individual sessions and participating in the discussions were such internationally known figures as Hans-Georg Gadamer of Germany, Eric Weil and Marcel Régnier of France, W. H. Walsh and Anthony Kenny of Great Britain, and Enrico de Negri of Italy. (shrink)

Paul Weiss continues the brilliant analysis of art he began in _The World of Art _and _Nine Basic Arts_—here_ _in the medium of film, at which he takes a close and inde­pendent look. Writing in a vigorous, jargon-free style, and covering all aspects of films and film making, Mr. Weiss presents a fresh, new approach to the study of our newest art. During the course of writing _Cinematics_,_ _Mr. Weiss asked various writers, critics, scholars, and producers long (...) involved with film to read and remark on what he had written. Five of them—Eric Sherman, Joseph Williman, Arthur Knight, David Slavitt, and Robert Thom—provided comments which are incorporated in the text. Their remarks are often trenchant, and perceptively provocative. These men frequently comment on lines of inquiry suggested in the book and often take issue with what has been said. The result is a kind of dialogue crisscrossed with stimu­lating insights. While this book is aimed at the general reader, Mr. Weiss hopes that experts and practitioners of film making will benefit from this fresh, independent, and philo­sophically based inquiry. Published in Vienna in 1936, _The Authoritarian State_ by Eric Voegelin has remained virtually unknown to the public until now. Sales of the German edition were halted following the Nazi invasion of Austria in 1938, and the entire printing was later destroyed by wartime bombing. In this volume, Voegelin offers a critical examination of the most prominent European theories of state and constitutional law of the period while providing a political and historical analysis of the Austrian situation. He discusses (...) the dismissal of Parliament in 1933, the civil war, the murder of Federal Chancellor Dollfuss, the adoption of the "Authoritarian Constitution" of 1934, and the predicament of being sandwiched between Hitler and Mussolini. A radical critique of Hans Kelsen's pure theory of law lies at the heart of this work, marking Voegelin's definitive departure from Neo-Kantian epistemology. For the first time, Voegelin elaborates on the important distinction between theoretical concepts and political symbols as a basis for explaining the nontheoretical and speculative character of ideologies, both left and right. He shows that _total_ and _authoritarian_ are symbols of ideological self-interpretation that have no theoretical value, a distinction basic to his later work in _The New Science of Politics._ Available for the first time in English, _The Authoritarian State_ is a valuable addition to the Voegelin canon and to the field of intellectual history in general. Social referencing informs and regulates one’s relation with the environment as a function of the perceived appraisals of social partners. Increased emphasis on relational and social contexts in the study of emotion makes this interpersonal process particularly relevant to the field. However, theoretical conceptualizations and empirical operationalizations of social referencing are disjointed across domains and populations of study. This article seeks to unite and refine the study of this construct by providing a clear and comprehensive definition of social referencing. Our (...) perspective presents social referencing and social appraisal as coterminous processes and emphasizes the importance of a relational and interpersonal approach to the study of emotion. To date, emotion research has primarily focused on the experience and display of the emoter. However, of equal, if not more, importance is how such displays impact and guide the behavior of an observer. We incorporate a functionalist framework of emotion to examine the development of differential responding to discrete emotion, theorize on what may facilitate its development, and hypothesize the functions that may underlie such behavioral responses. Climate change and justice are so closely associated that many people take it for granted that a global climate treaty should--indeed, must--directly address both issues together. But, in fact, this would be a serious mistake, one that, by dooming effective international limits on greenhouse gases, would actually make the world's poor and developing nations far worse off. This is the provocative and original argument of Climate Change Justice. Eric Posner and David Weisbach strongly favor both a climate change agreement (...) and efforts to improve economic justice. But they make a powerful case that the best--and possibly only--way to get an effective climate treaty is to exclude measures designed to redistribute wealth or address historical wrongs against underdeveloped countries. In clear language, Climate Change Justice proposes four basic principles for designing the only kind of climate treaty that will work--a forward-looking agreement that requires every country to make greenhouse--gas reductions but still makes every country better off in its own view. This kind of treaty has the best chance of actually controlling climate change and improving the welfare of people around the world. (shrink)

Attempts to explain emotion typically emphasize the interaction of evolutionary and socialization processes. However, in describing this interplay the role of the person is typically underemphasized or unaccounted for. This paper lays out empirical and theoretical rationale for considering the person as a major contributor to emotion generation and development.

Carroll Izard completed his dissertation in 1952, beginning a career spanning more than six decades that coincided with clinical psychology maturing as a profession, and the birth of clinical science and cognitive neuroscience. Izard’s focus on discrete emotions as evolved systems that organize information, prepare responses, and shape the development of personality and relationships persisted through his career, despite “emotions” often being overshadowed by psychodynamic, behavioral, or cognitive perspectives. His theoretical work anticipated and now integrates contemporary neuroscience and relational perspectives. (...) Exploration of discrete emotions has kept lines of inquiry open that enrich our understanding of psychopathology. Izard also embraced clinical science, combining basic research with effectiveness studies addressing the unmet need for mental health services via emotion-focused interventions. (shrink)

We are encouraged by the attention paid to fundamental aspects relating to the interpersonal functions of emotion. In continuing this discussion, we consider two arguments used to distinguish social referencing and social appraisal, namely the role of ostension and the absence of prior appraisals of the individual. We contend that neither element is essential to social referencing.

Armed reprisals are the limited use of military force in response to unlawful actions perpetrated against states. Historically, reprisals provided a military remedy for states that had been wronged by another state without having to resort to all-out war in order to counter or deter such wrongful actions. While reprisals are broadly believed to have been outlawed by the UN Charter, states continue to routinely undertake such self-help measures. As part of the roundtable, “The Ethics of Limited Strikes,” this essay (...) examines the doctrine of armed reprisals in light of recent instances of states using force “short of war” in this manner. We argue that the ban on reprisals has been largely ignored by states, and that recent attempts to apply the laws of armed conflict to the cyber domain are further weakening this prohibition. We conclude that this is a potentially dangerous development that lowers the bar for resorting to military force, risking escalation and thereby further destabilizing the international system. In a survey on research misconduct, roughly 20% of the respondents admitted that they have submitted federal grant proposals that include scholars as research participants even though those scholars were not expected to contribute to the research effort. This manuscript argues that adding such false investigators is illegal, violating multiple federal statutes including the False Statements Act, the False Claims Act, and False, Fictitious, or Fraudulent Claims. Moreover, it is not only the offending academics and the false investigators that face (...) civil and criminal penalties because administrators may also be liable if they sign off on proposals and are in a position to know that false investigators might be included. Policy recommendations that should reduce the use of false investigators include changing institutional cultures, better training and oversight of the responsible conduct of research, and, most importantly, making all grant reviews double blind. Abstract Finding a moral justification for humanitarian intervention has been the objective of a great deal of academic inquiry in recent years. Most of these treatments, however, make certain arguments or assumptions about the morality of humanitarian intervention without fully exploring their precise philosophical underpinnings, which has led to an increasingly disjointed body of literature. The purpose of this essay, therefore, is to suggest that the conventional arguments and assumptions made about the morality of humanitarian intervention can be encompassed in (...) what is essentially a consequentialist framework. After a brief examination of consequentialist ethics, this essay reveals a number of morally relevant factors concerning humanitarian intervention, wherein I suggest that the general consensus in the literature on these factors constitutes ?commonsense morality?. In doing so, I argue that consequentialism as a theory of the right provides the best fit with commonsense morality on humanitarian intervention. This is important not only to reveal the precise philosophical underpinnings of the debate, but also to bring ethical, prudential and political considerations together in a coherent ethical discourse. Few novel or emerging infectious diseases have posed such vital ethical challenges so quickly and dramatically as the novel coronavirus SARS‐CoV‐2. The World Health Organization declared a public health emergency of international concern and recently classified Covid‐19 as a worldwide pandemic. As of this writing, the epidemic has not yet peaked in the United States, but community transmission is widespread. President Trump declared a national emergency as fifty governors declared state emergencies. In the coming weeks, hospitals will become overrun, stretched (...) to their capacities. When the health system becomes stretched beyond capacity, how can we ethically allocate scarce health goods and services? How can we ensure that marginalized populations can access the care they need? What ethical duties do we owe to vulnerable people separated from their families and communities? For over 700 years scholastic theologians of varying degrees of allegiance to the text(s) of Thomas Aquinas have discoursed on the mystery of Christ's being (esse): Did Christ have one or two acts of existence? Yet despite this frequent and recurring quaestio, nevertheless only a handful of scholastic commentators pause to note that this is not simply a debate between rival scholastic ‘schools’ in regard to a theological mystery, but that in fact there is an inconsistency within the Angelic doctor's (...) own texts. And while in more recent scholarship this discrepancy has not only been noticed but explicated in various ways, nevertheless it is the contention of this paper that a satisfactory exposition of the meaning of esse secundarium has not yet been achieved. Consequently, I propose in this paper that esse secundarium is the created, substantial, but absolutely supernatural participation of the human nature of Jesus in the uncreated communication of the divine esse of the Word and provide a robust textual defense of this interpretation. The answer to this question is challenging and complex. The claim most aesthetic theories make is that an object, activity, or experience is artful if and only if it has intrinsic value. The cost of health care, its growing share of the gross domestic product, and dire predictions about the future are a major political and economic issue in the U.S. The American legal system is commonly viewed as a significant part of the problem, particularly by those who believe that medical providers engage in defensive medicine in an effort to avoid malpractice litigation. Yet scholars and commentators in the U.S. have shown relatively little interest in how other nations manage legal conflict (...) over health care and whether they might learn something from abroad about the relationship between malpractice litigation and the health care system more generally.To that end, this article analyzes the Japanese health care experience, specifically the management of what are variously called adverse outcomes, medical accidents, and medical malpractice. How frequently do Japanese patients sue their doctors? Are medical malpractice litigation rates in Japan rising? If so, what is being done to control the increase and its impact on medical care? How well is Japan doing when it comes to balancing the needs of patients who believe they are victims of medical negligence with those of providers who think they are being unfairly accused? These are the questions, about Japan, that need to be asked by those interested in the nexus of law and health care in the U.S. (shrink)

Scholars in the U.S. have shown relatively little interest in the management of legal conflict over health care in other nations. This article examines the Japanese health care system, particularly litigation over medical malpractice, and asks what American scholars and policy makers can learn from the Japanese experience.

Despite the bad press, Plato has a valid argument for immortality from three premises: (1) if the natural evil of a thing cannot destroy it, then it is indestructible; (2) the natural evil of the soul is vice; and (3) vice cannot destroy the soul. These premises are contestable, of course, but Plato has some good reasons for advancing them.

Sexually reproducing metazoans establish a cell lineage during development that is ultimately dedicated to gamete production. Work in a variety of animals suggests that a group of conserved molecular determinants act in this germ line maintenance and function. The most universal of these genes are Vasa and Vasa‐like DEAD‐box RNA helicase genes. However, recent evidence indicates that Vasa genes also function in other cell types, distinct from the germ line. Here we evaluate our current understanding of Vasa function and its (...) regulation during development, addressing Vasa's emerging role in multipotent cells. We also explore the evolutionary diversification of the N‐terminal domain of this gene and how this impacts the association of Vasa with nuage‐like perinuclear structures. (shrink)

In 1864 - two years before the publication of The Communist Manifesto and 21 years before the publication of Das Kapital - Karl Marx published an essay titled Peuchet on Suicide. The essay was originally presented as a translation of excerpts from the memoirs of Jacques Peuchet, a leading French police administrator, economist and statistician. Plaut and Anderson reveal that Marx's Peuchet on Suicide is not a straightforward translation, but is an edited version in which Marx adds passages of his (...) own, altering the emphasis of the text from a moral and psychological focus to a profoundly social one. Thus, the essay very strongly reflects Marx's own position on this controversial subject. Sociologist Kevin Anderson provides an extensive introduction situating the essay in the context of Marx's work, especially that on gender; Plaut's essay focuses on the psychological aspects of the work, in particular contrasting Marx's thoughts on suicide with those of Freud and Durkheim. Human rights law does not appear to enjoy as high a level of compliance as the laws of war, yet is institutionalized to a greater degree. This Article argues that the reason for this difference is related to the strategic structure of international law. The laws of war are governed by a regime of reciprocity, which can produce selfenforcing patterns of behavior, whereas the human rights regime attempts to produce public goods and is thus subject to collective action problems. The (...) more elaborate human rights institutions are designed to overcome these problems but fall prey to second-order collective action problems. The simple laws of war institutions have been successful because they can exploit the logic of reciprocity. The Article also suggests that limits on military reprisals are in tension with self-enforcement of the laws of war. The U.S. conflict with Al Qaeda is discussed. (shrink)

Although much legal scholarship discusses the meaning of the religion clauses of the U.S. Constitution, very few articles analyze the ways in which state regulation affects actors' incentives to engage in religious behavior. Yet the question of how a law influences religious behavior is important for determining whether various laws are desirable, and whether they violate constitutional constraints. This article draws on recent economic models of religious organization to analyze the ways in which laws affect the behavior of religious groups. (...) Religious groups produce collective goods for their members, and the effect of laws can be analyzed by examining how they modify the payoffs members receive for cooperating or free riding. The article examines the use of laws to establish religious groups, to subsidize them with cash or tax benefits, to provide accommodations for them, to provide symbolic support for them, to provide secular substitutes for the collective goods they produce, and to regulate disputes between members.
